RBI Fines Axis Bank and HDFC Bank

The Reserve Bank of India (RBI) on Tuesday (10 September) imposed monetary penalties on two major banks, Axis Bank and HDFC Bank, for non-compliance with various regulatory directives. On 3 September 2024, Axis Bank was fined Rs 19.1 bn, while HDFC Bank faced a penalty of Rs 10 m.

Axis Bank's penalty of Rs 19.1 m stems from findings during a statutory inspection for supervisory evaluation (ISE 2023). The inspection, conducted concerning the bank's financial position as of 31 March 2023, revealed several contraventions of the Banking Regulation Act, of 1949.

According to the RBI, the bank opened savings deposit accounts for ineligible entities, failed to provide unique customer identification codes (UCIC), and improperly secured collateral for agricultural loans up to Rs 1.6 lakh.

Additionally, a wholly-owned subsidiary of the bank acted as a technology service provider, which is not a permissible business that can be undertaken by a banking company.

The statutory inspection for supervisory evaluation (ISE 2022) of the bank was conducted by RBI with reference to its financial position as of 31 March 2022.

Both penalties are intended to address deficiencies in statutory and regulatory compliance without questioning the validity of any transactions or agreements made by the banks.

A Creeping Acquisition generally means when someone gradually continues to increase his / her stake in the company over a period of time.

In the financial year 2021, the market regulator raised the creeping acquisition limit to 10% from 5% earlier. This relaxation though, was only applicable to preferential allotment of equity shares and did not apply to transfers, block or bulk deals.

Takeover regulations would be applicable if the promoter group crosses the Creeping Acquisition limit of 5% in a financial year.

The Society of Indian Automobile Manufacturers (Siam), the apex body representing India's leading automobile manufacturers, on Tuesday announced the election of Shailesh Chandra, Managing Director of Tata Motors Passenger Vehicles, as its new president for the term 2024-25.
